These Terms of Service ("Terms") govern your use of the website and meal-delivery subscription service provided by The Simple Spoon LLC ("we," "us," or "our"). By creating an account or placing an order, you agree to these Terms.
We offer a weekly meal-prep subscription. Each week we publish a rotating menu of chef-prepared meals, freshly cooked and delivered ready to heat and enjoy. We currently deliver throughout South Florida, from Pembroke Pines to Cutler Bay.
You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account.
Each week you may select your meals by the Wednesday deadline. If no selections are made by the deadline, our team will thoughtfully choose meals for you from that week's menu.
You may pause, skip a week, or cancel your subscription at any time before Thursday at 4:00 PM for the following week. There are no cancellation fees. Changes made after the deadline take effect the week after.
Fresh meals are delivered on Mondays between 12:00 PM and 6:00 PM. If you are not home, meals may be left in a safe location; we recommend leaving a cooler with an ice pack. Once meals are delivered, it is your responsibility to refrigerate them promptly. Meals are designed to stay fresh in the refrigerator for up to 7 days.
You may opt in at checkout to receive delivery text messages from The Simple Spoon. If you do, we text you on your delivery day when the driver leaves for your address, with an estimated arrival time. These are transactional delivery notifications only — we do not send marketing or promotional texts through this program.
Opting in is not required to place an order. Message frequency is about one message per scheduled delivery, roughly one per week. Message and data rates may apply, as set by your mobile carrier. Reply STOP to any message to end all delivery texts, or HELP for help. Carriers are not liable for delayed or undelivered messages. How we handle your mobile number is described in our Privacy Policy — we never share or sell it for third-party marketing.
We accommodate most major allergens and dietary preferences and offer substitutions and modifications whenever possible. However, our meals are prepared in a shared kitchen, and we cannot guarantee a meal is completely free of any allergen. Please review meal information and contact us with any concerns.
Because meals are freshly prepared and perishable, refunds are handled as described in our Refund & Cancellation Policy.
You agree not to misuse the website, interfere with its operation, or use it for any unlawful purpose.
To the fullest extent permitted by law, The Simple Spoon LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid for the affected order.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. Continued use of the service after changes take effect means you accept the updated Terms.
