These Terms of Service ("Terms") govern your use of the website and meal-delivery subscription service provided by The Simple Spoon LLC ("we," "us," or "our"). By creating an account or placing an order, you agree to these Terms.
We offer a weekly meal-prep subscription. Each week we publish a rotating menu of chef-prepared meals, freshly cooked and delivered ready to heat and enjoy. We currently deliver throughout South Florida, from Pembroke Pines to Cutler Bay.
You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs under your account.
Each week you may select your meals by the Wednesday deadline. If no selections are made by the deadline, our team will thoughtfully choose meals for you from that week's menu.
You may pause, skip a week, or cancel your subscription at any time before Thursday at 4:00 PM for the following week. There are no cancellation fees. Changes made after the deadline take effect the week after. Just remember to return our bags (see Reusable bags below).
Fresh meals are delivered on Mondays between 12:00 PM and 6:00 PM. If you are not home, meals may be left in a safe location; we recommend leaving a cooler with an ice pack. Once meals are delivered, it is your responsibility to refrigerate them promptly. Meals are designed to stay fresh in the refrigerator for up to 7 days.
Your meals arrive in our insulated bags. They’re on loan from us, and we reuse them week after week.
Program name: The Simple Spoon Delivery Alerts.
If you check the delivery-text box when you sign up at thesimplespoon.com/signup.html, or later in your member account, we text the mobile number you gave us on each of your delivery days, when your driver is on the way, with an estimated arrival time. These are transactional notifications about your own delivery. We do not send marketing or promotional messages through this program.
How we handle your mobile number is described in the delivery text messages section of our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
We accommodate most major allergens and dietary preferences and offer substitutions and modifications whenever possible. However, our meals are prepared in a shared kitchen, and we cannot guarantee a meal is completely free of any allergen. Please review meal information and contact us with any concerns.
Because meals are freshly prepared and perishable, refunds are handled as described in our Refund & Cancellation Policy.
You agree not to misuse the website, interfere with its operation, or use it for any unlawful purpose.
To the fullest extent permitted by law, The Simple Spoon LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid for the affected order.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. Continued use of the service after changes take effect means you accept the updated Terms.
